1. Introduction

WorldDialer (the “Service”), operated by Polyiota LLC, a Delaware limited liability company (“Company,” “we,” “us,” or “our”), respects intellectual property rights and maintains a strict policy against copyright infringement. This DMCA/Copyright Policy (“Policy”) outlines our procedures for addressing claims of copyright infringement and protecting the rights of copyright owners.

This Policy is designed to comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) and other applicable copyright laws, including the EU Copyright Directive (DSM Directive), UK Copyright, Designs and Patents Act, and international copyright frameworks.

2. DMCA Notice Requirements (17 U.S.C. § 512(c)(3))

If you believe that copyrighted material has been infringed on or through the WorldDialer Service, you may submit a written notice of copyright infringement to our Designated Agent. To be effective, your notice must include the following information:

  1. A physical or electronic signature of the copyright owner or an authorized representative;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are claimed, a representative list of such works;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Company to locate the material, including but not limited to URLs or specific locations where the material appears;
  4. Contact information for the copyright owner or authorized representative, including a valid email address and telephone number;
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement made under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and
  7. Your physical or electronic signature.

Notices lacking the above information may not be effective, and we may not be obligated to act upon them.

3. Counter-Notification Procedure

If material is removed or access to material is disabled in response to a DMCA notice, the user whose material was removed may file a counter-notification with our Designated Agent. The counter-notification must include:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of federal court for the judicial district in which the address is located, or if your address is outside the United States, that you consent to jurisdiction in the U.S. District Court for the Northern District of California; and
  5. A statement that you will accept service of process from the person who provided the DMCA notice.

Upon receipt of a valid counter-notification, we will restore the material within 10-14 business days unless the copyright claimant provides notice that legal action has been initiated.

We will endeavor to acknowledge receipt of your DMCA notice within 24 business hours and will investigate all complaints promptly.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, the Company will implement and enforce a reasonable policy that provides for the termination in appropriate circumstances of users who are repeat infringers of copyrighted material. We reserve the right to terminate user accounts and/or access to the Service for users who repeatedly infringe copyright or other intellectual property rights, either by multiple notifications or by other evidence of willful infringement.

In addition to DMCA compliance, we respect the copyright laws of jurisdictions outside the United States, including but not limited to:

  • EU Copyright Directive (2019/790 - Digital Services Markets Directive);
  • UK Copyright, Designs and Patents Act 1988;
  • Canadian Copyright Act; and
  • Other international copyright frameworks and treaties.

Copyright holders outside the United States may submit notices of infringement using the same contact information provided above. We will process such notices in accordance with applicable laws in the relevant jurisdiction.

7. Good Faith Belief and Misrepresentation Warning

Under 17 U.S.C. § 512(f), you may be subject to liability if you knowingly materially misrepresent that material or activity is infringing. This means that if you file a DMCA notice and materially misrepresent that content is infringing when it is not, you could be held liable for damages, including costs and attorney’s fees.

Similarly, if you file a counter-notification and materially misrepresent that material was disabled or removed in error, you may also face liability. We strongly encourage all parties to consider whether they have a good faith basis for their claims before submitting notices or counter-notifications.

8. Limitation of Liability

The Company acts as a conduit for communications and is not responsible for reviewing all content on the Service. While we take copyright infringement seriously, we do not warrant that we will discover all infringing material or that we will act immediately upon receiving a notice.

To the extent permitted by law, neither the Company nor its officers, directors, employees, or agents shall be liable for any indirect, incidental, special, consequential, or punitive damages, or damages for lost profits, arising out of or relating to this Policy or the handling of DMCA notices.

9. Changes to This Policy

The Company reserves the right to modify this Policy at any time without prior notice. Changes to this Policy will be effective immediately upon posting to our website. Your continued use of the Service following the posting of revisions constitutes your acceptance of such changes. We recommend that you review this Policy periodically for updates.
