1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Polyiota LLC ("Company," "we," "us," or "our") regarding your use of WorldDialer.com, our Voice over Internet Protocol (VoIP) service. By creating an account or using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use our services.
2. Description of Services
2.1 VoIP Services
WorldDialer.com provides internet-based communication services that enable users to:
- Make voice calls to landlines and mobile phones globally using VoIP technology
- Send and receive SMS messages (Premium subscription required)
- Receive and manage voicemail messages (Premium subscription required)
- Manage contacts and communication history
- Purchase and manage calling credits through our platform
- Access premium features through subscription plans
2.2 Premium Subscription Features ($9/month)
- Dedicated US phone number for caller ID
- SMS messaging capabilities (send and receive)
- Voicemail receiving and management
- Discounted calling rates (12¢ vs 15¢ per minute)
- Enhanced customer support
2.3 Service Limitations
⚠️ Emergency calling (911, 112, or equivalent emergency services) is NOT available through our service
- Internet Dependency: Service requires stable internet connection and compatible web browser
- Geographic Restrictions: Service availability depends on Twilio's network coverage
- Browser Requirements: Requires modern web browser with WebRTC support and microphone permissions
- Call Quality: May vary based on internet connection, network conditions, and destination
- Third-Party Dependencies: Service availability depends on third-party infrastructure
3. User Eligibility and Registration
3.1 Age Requirement
You must be at least 18 years old to use our services. By using our services, you represent and warrant that you meet this age requirement.
3.2 Registration Information
To use our services, you must:
- Provide a valid email address for account creation
- Optionally provide your name for account personalization
- Maintain the security of your account credentials
- Be responsible for all activities under your account
4. Payment Terms and Credits System
4.1 Credit System
- Our calling services operate on a prepaid credit system (1 credit = 1 minute of calling)
- Standard Rate: 15¢ per credit for non-premium users
- Premium Rate: 12¢ per credit for premium subscribers (20% discount)
- Credits are purchased through Stripe payment processor
- Maximum Limits: $500 per transaction, 1000 credits per purchase
- Credits do not expire but may be subject to account inactivity policies
4.2 Premium Subscriptions
Monthly Subscription: $9 per month, billed monthly
Features: Dedicated US phone number, SMS, voicemail, discounted rates
Refund Policy: 24-hour refund window for unused services
4.3 Billing and Charges
- Calls are billed per second with a 15-second minimum charge
- Real-time cost estimation provided during calls
- Automatic deduction of credits from your account balance
- All payments processed securely through Stripe
5. Acceptable Use Policy
5.1 Permitted Uses
Our services may only be used for legitimate voice communication and messaging purposes in compliance with all applicable laws and regulations.
5.2 Prohibited Uses
You may NOT use our services for:
- Spam calling, robocalling, or unsolicited commercial communications
- Harassment, threats, or abusive communications
- Illegal activities or communications that violate applicable laws
- Fraud, deception, or misrepresentation of identity
- Automated calling without proper authorization and consent
- Sending unsolicited SMS messages or spam texts
- Any activity that could damage, disable, or impair our services
6. Privacy and Data Protection
6.1 Privacy Policy Integration
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
6.2 Data Collection and Use
We collect and process:
- Account information (email, name, preferences)
- Communication data (call logs, SMS messages, voicemail recordings)
- Usage data (IP addresses, device information, usage patterns)
- Payment information (processed by Stripe, not stored by us)
- Contact information you choose to store in our system
6.3 Data Retention
- Call history: 12 months from call date
- SMS messages: 12 months from send/receive date
- Voicemail recordings: 12 months from receipt
- Account information: 36 months after account closure
- Payment records: 7 years for tax and legal compliance
7. Account Termination
7.1 Termination by User
You may terminate your account at any time. Upon voluntary termination:
- Unused credits will be refunded within 30 days
- Your account data will be handled according to our Privacy Policy
- Premium subscription cancellation takes effect at period end
7.2 Termination by Company
We reserve the right to suspend or terminate your account for:
- Violation of these Terms or our Acceptable Use Policy
- Suspected fraudulent, abusive, or illegal activity
- Legal requirements or court orders
- Extended account inactivity (over 12 months)
8. Limitation of Liability
Emergency Services Disclaimer
YOU ACKNOWLEDGE AND AGREE THAT OUR SERVICES DO NOT SUPPORT EMERGENCY CALLING TO 911, 112, OR OTHER EMERGENCY SERVICES. YOU MUST HAVE ALTERNATIVE MEANS TO CONTACT EMERGENCY SERVICES.
8.1 Service Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 Liability Limitations
IN NO EVENT SHALL POLYIOTA LLC BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, business opportunities, or revenue
- Damages resulting from service interruptions or technical failures
- Damages exceeding the amount you paid for services in the preceding 12 months
9. Governing Law and Disputes
9.1 Applicable Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
9.2 Dispute Resolution
Legal disputes shall be resolved through:
- Good faith negotiations between the parties
- Binding arbitration if informal resolution fails
- Individual basis only (no class actions)
10. Changes to Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' advance notice through email notification and prominent notice on our website.
Your continued use of our services after changes become effective constitutes acceptance of the modified Terms.
