1. Acceptance of Terms

These Terms of Service (“Terms,” “Agreement,” or “ToS”) govern your access to and use of the WorldDialer service (the “Service”), including its website at worlddialer.com and all associated applications, features, and functionality (collectively, the “Platform”). WorldDialer is owned and operated by Polyiota LLC, a Delaware limited liability company (“WorldDialer,” “we,” “us,” “our,” or “Company”).

By accessing, browsing, or using WorldDialer, whether through a web interface, mobile application, API, or any other means, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms in their entirety. If you do not agree to these Terms, you must not use the Platform.

We reserve the right to modify these Terms at any time. Material changes will be notified to you via email or through a prominent notice on the Platform. Continued use of the Service after such modifications constitutes acceptance of the updated Terms. Your continued use of WorldDialer after any changes have been posted will be deemed acceptance of those changes.

2. Eligibility and User Requirements

2.1 Eligibility Criteria

  • You must be at least eighteen (18) years of age or older at the time of registration.
  • You must have the legal capacity to enter into a binding contract in your jurisdiction of residence.
  • You must be complying with all applicable local, state, national, and international laws and regulations.
  • You must not be a person or entity barred from receiving services under the laws of the United States or any other applicable jurisdiction.
  • You must not have been previously suspended or terminated from WorldDialer for any reason.

You represent and warrant that you will use the Service only for lawful purposes and in a manner that does not violate any applicable laws, regulations, or the rights of any third party. You further represent that you are not acting on behalf of any person, entity, or jurisdiction subject to sanctions or restrictions that would prohibit your use of the Service.

2.3 Restricted Jurisdictions

The Service may not be available in certain jurisdictions or to certain classes of users due to regulatory requirements. WorldDialer reserves the right to restrict or deny access to the Service from any jurisdiction at its sole discretion.

3. Account Registration and Security

3.1 Account Creation

To use WorldDialer, you must create a user account by providing accurate, truthful, and complete information as requested during the registration process. This may include your name, email address, phone number, billing address, and payment information. You are solely responsible for maintaining the accuracy of your account information and updating it as necessary.

3.2 Account Credentials

You are responsible for maintaining the confidentiality of your account login credentials, including your password and any authentication codes. You agree to accept responsibility for all activities that occur under your account. You must immediately notify WorldDialer of any unauthorized access or use of your account by contacting support@worlddialer.com.

3.3 Security Obligations

You agree to take reasonable measures to protect your account information and to use strong passwords. WorldDialer is not liable for any loss, damage, or unauthorized access resulting from your failure to maintain adequate security practices. We recommend enabling two-factor authentication if available.

3.4 Account Termination

You may terminate your account at any time by logging into your account settings or by contacting support@worlddialer.com. Upon termination, you will no longer have access to the Service, and any remaining account balance will be handled in accordance with Section 5.5 below.

4. Description of Service

4.1 Service Overview

WorldDialer is a cloud-based Voice over Internet Protocol (VoIP) platform that enables users to make telephone calls to phone numbers worldwide via an internet connection. The Service provides pay-per-use calling functionality based on a credit system, as well as optional subscription services for private and dedicated phone numbers.

4.2 Service Features

  • International calling to destinations worldwide
  • Pay-per-use credit system with transparent, published rate schedules
  • Optional subscription plans for dedicated phone numbers
  • Number portability and management features (for subscription users)
  • Call logs, history, and analytics
  • API access for programmatic call initiation (subject to additional API Terms)
  • Customer support via email and support portal

4.3 Service Availability

WorldDialer makes reasonable efforts to maintain service availability, but does not guarantee uninterrupted access or operation. The Service may be temporarily unavailable for maintenance, updates, or other reasons beyond our control. WorldDialer is not responsible for any downtime, loss of access, or service interruptions.

4.4 No Emergency Services

The Service is not designed for emergency use and should not be relied upon for emergency communications. WorldDialer cannot guarantee the ability to call emergency numbers such as 911 (United States), 112 (Europe), or equivalent emergency services in other jurisdictions. You must use traditional telephone services or other reliable communication methods for emergencies.

4.5 Quality and Performance

While we strive to provide quality service, call quality depends on various factors including your internet connection, network congestion, and the destination’s infrastructure. WorldDialer does not guarantee call quality, uptime, or successful connection to all destinations. Call failures may occur due to network issues, provider limitations, or regulatory restrictions.

5. Payment Terms

5.1 Payment Methods and Processing

Payment for the Service is processed through Stripe, a third-party payment processor (“Payment Processor”). By using WorldDialer, you authorize Stripe to charge your payment method for all charges incurred. Stripe’s terms of service and privacy policy are incorporated by reference. You acknowledge that Stripe is solely responsible for the security and processing of payment information.

5.2 Pay-Per-Use Credits

The Service operates on a pay-per-use credit system. You may purchase calling credits at any time by adding funds to your account. The cost of calls is deducted from your credit balance based on the destination country and duration of the call. Our current rate schedule is available on the Platform and may be updated from time to time at our sole discretion.

Credits are non-refundable after the call has been completed. Unused credits have no expiration date and will remain in your account indefinitely, provided your account remains active and in good standing.

5.3 Subscription Services

Optional subscription plans are available for dedicated phone numbers and premium features. Subscription fees are billed on a recurring basis (monthly, annually, or as specified in the plan terms) and are charged automatically to your payment method on the anniversary of the billing cycle.

Subscriptions are renewed automatically unless you cancel prior to the next billing date. Cancellation of a subscription does not refund charges already incurred for the current billing cycle.

5.4 Cancellation and Refunds

You may cancel a subscription at any time by accessing your account settings or by contacting support@worlddialer.com. Cancellation takes effect at the end of the current billing cycle, and you will continue to have access to paid features until that date. No partial refunds will be issued for cancelled subscriptions during the current billing period.

For EU/EEA consumers only: If you are a consumer resident in the European Union, European Economic Area, or UK, you have the right to withdraw from this Agreement within fourteen (14) calendar days of purchase without providing a reason (the “Withdrawal Period”). See Section 18.1 for additional EU/EEA consumer rights.

5.5 Currency and Taxes

All prices are displayed in United States Dollars (USD) unless otherwise specified. You are responsible for paying any applicable sales, value-added, goods and services, or other taxes related to your purchase. WorldDialer will collect and remit applicable taxes as required by law in your jurisdiction.

If you are a non-U.S. customer, you may be charged additional import duties or taxes depending on your country of residence.

5.6 Failed Payments and Collection

If a payment fails or is declined, WorldDialer may attempt to charge your payment method again. If payment fails repeatedly, your account access may be suspended or terminated at our discretion. You remain responsible for all outstanding charges.

Failure to pay charges may result in collection action, including but not limited to collection agency involvement, small claims court proceedings, or other legal remedies available to WorldDialer under applicable law.

5.7 Billing Disputes

If you dispute a charge, you must contact support@worlddialer.com within thirty (30) days of the charge appearing on your account. After thirty days, all charges are considered accepted. Disputes must be reported to your payment provider within the timeframe specified by your payment provider’s chargeback policy.

5.8 Promotional Credits and Offers

Promotional credits, free trial periods, or special offers may be provided at WorldDialer’s sole discretion. These promotions are subject to specific terms and conditions that will be clearly stated at the time of offer. Promotional credits expire as specified and are non-transferable.

6. Acceptable Use

6.1 Prohibited Uses

You agree not to use the Service in any manner that violates applicable laws, regulations, or third-party rights. Prohibited uses include, but are not limited to:

  • Placing calls for illegal purposes, including facilitating illegal activity, fraud, or harassment
  • Making calls to harass, threaten, abuse, defame, or obscene communication to any person or entity
  • Spoofing caller ID information or misrepresenting your identity to deceive recipients
  • Initiating robocalls, auto-dialing, SMS text message blasts, or automated calling in violation of the Telephone Consumer Protection Act (TCPA) or equivalent laws
  • Violating the Telecom regulations of the jurisdiction in which the call is being placed, including porting regulations, per-call consent requirements, and licensing restrictions
  • Making calls to numbers designated as “Do Not Call” registries without proper exemptions or consent
  • Using the Service for telemarketing, spam, or unsolicited communications in violation of applicable marketing regulations
  • Attempting to access WorldDialer systems or networks without authorization, including hacking, penetration testing, or vulnerability research without written permission
  • Reselling, redistributing, or providing access to the Service to third parties without authorization
  • Interfering with or disrupting the normal operation of the Service or its servers
  • Using the Service to test security vulnerabilities or conduct unauthorized security research
  • Any other use that WorldDialer deems inappropriate, harmful, or in violation of these Terms

6.2 Compliance with Telecom Laws

You are solely responsible for understanding and complying with all telecommunications regulations applicable to your calls, including but not limited to the Telephone Consumer Protection Act (TCPA) in the United States, the Online and Offline Physical Law Regulations (OOPL) in the UK (Ofcom), General Data Protection Regulation (GDPR) in the EU, and equivalent regulations in other jurisdictions. Failure to comply with these regulations may result in significant fines and penalties.

6.3 TCPA Compliance

If using the Service in the United States, you must comply with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and the Federal Trade Commission’s Telemarketing Sales Rule (TSR). This includes:

  • Obtaining prior express written consent before using auto-dialing or prerecorded messages to cell phones
  • Maintaining and honoring Do Not Call lists
  • Identifying yourself and your business at the beginning of the call
  • Providing callback numbers and honoring opt-out requests
  • Maintaining proper calling time restrictions (no calls before 8 AM or after 9 PM the recipient’s time zone)

6.4 Acceptable Use Policy

WorldDialer maintains a detailed Acceptable Use Policy (“AUP”) that supplements these Terms. The AUP provides additional guidance on prohibited and restricted uses of the Service. The current AUP is available on our website at worlddialer.com/aup and is incorporated into these Terms by reference.

6.5 Monitoring and Enforcement

WorldDialer reserves the right to monitor calls, call patterns, and account activity to detect and prevent violations of these Terms and applicable laws. While we do not record the content of your calls, we may review metadata including call duration, frequency, destination, and patterns of use. Violations may result in account suspension, termination, and legal action.

7. User Content and Communications

7.1 Responsibility for Call Content

You are solely and fully responsible for the content, legality, accuracy, and decency of any calls you place through the Service. WorldDialer does not endorse, monitor, or control the content of your calls and disclaims all liability for any illegal, defamatory, obscene, or otherwise objectionable content transmitted through the Service.

Unless required by applicable law, WorldDialer does not record the audio content of your calls. You are solely responsible for obtaining proper consent from all parties before recording any call. Recording without consent may violate laws in one-party or two-party consent jurisdictions and may result in criminal or civil liability. WorldDialer is not responsible for any violations of recording consent laws.

7.3 Call Metadata and Logs

WorldDialer may collect and retain metadata associated with calls, including but not limited to:

  • Calling and called phone numbers
  • Call date, time, and duration
  • Billing information and credit usage
  • IP addresses and device information

This metadata is retained per our Privacy Policy and may be used for billing purposes, fraud detection, legal compliance, and customer support. Metadata may be retained for extended periods as required by law or for business purposes.

WorldDialer may be required by law, regulation, or legal process (including subpoena, court order, or regulatory request) to disclose call metadata, account information, or other user information. We will comply with lawful requests to the extent required by law. Whenever legally permissible, we will provide notice to the user before disclosing such information.

7.5 Your Rights to Your Content

You retain all rights to any content you create and transmit through the Service. By using the Service, you grant WorldDialer a limited license to use call metadata and aggregated usage data for operational, billing, support, and safety purposes.

8. Intellectual Property Rights

8.1 Ownership of Platform IP

All content, features, functionality, software, and materials comprising the WorldDialer Platform, including but not limited to the website, mobile applications, APIs, code, designs, graphics, interfaces, trademarks, logos, and service marks, are the exclusive property of Polyiota LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License to Use Service

Subject to your compliance with these Terms, WorldDialer grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial use. This license does not include the right to:

  • Reproduce, copy, or create derivative works of the Service
  • Modify, adapt, translate, or create works based on the Service
  • Resell, redistribute, lease, or sublicense the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to develop competing products or services
  • Remove any copyright, trademark, or proprietary notices

8.3 User Content Rights

You retain all rights to any content you originate and transmit through the Service. By using the Service, you grant WorldDialer a worldwide, royalty-free, non-exclusive license to use call metadata, aggregated data, and anonymized usage information for service improvement, fraud prevention, and business analytics.

8.4 Feedback and Suggestions

If you provide any feedback, suggestions, or ideas regarding the Service (“Feedback”), you grant WorldDialer a worldwide, royalty-free, perpetual, irrevocable license to use such Feedback without restriction or compensation.

9. Third-Party Services and Integrations

9.1 Third-Party Providers

WorldDialer relies on third-party service providers to deliver the Service, including but not limited to:

  • Twilio Inc. - VoIP and telephony infrastructure provider
  • Stripe, Inc. - Payment processing and billing services
  • Google Analytics - Website and service analytics

Your use of the Service implies acceptance of the terms and privacy policies of these third-party providers. WorldDialer is not responsible for the services, policies, or practices of third parties.

9.2 Twilio Terms

Calls are routed through Twilio’s infrastructure, and you are subject to Twilio’s Terms of Service and Acceptable Use Policy. Twilio may impose additional restrictions on the types of calls or destinations that can be reached. Call failures or service interruptions may result from Twilio’s network limitations or policies.

9.3 Stripe Payment Terms

Payment processing is handled by Stripe. Your payment information is subject to Stripe’s Privacy Policy and Security Standards. WorldDialer does not store, process, or have access to your full payment card information. By paying for the Service, you agree to Stripe’s terms.

The Platform may contain links to third-party websites or services. WorldDialer is not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is governed by their respective terms and policies.

10. Disclaimers and Limitation of Liability

10.1 Service “AS IS” Disclaimer

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. WORLDDIALER EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

10.2 No Guarantee of Quality or Availability

WORLDDIALER DOES NOT WARRANT THAT:

  • The Service will be uninterrupted, timely, or error-free
  • Call quality, clarity, or successful connections will be achieved
  • All destinations are reachable or supported
  • The Service will meet your specific needs or requirements
  • Any defects in the Service will be corrected
  • The Service will be compatible with all devices or networks

10.3 Third-Party Provider Disclaimers

WorldDialer is not responsible for failures, interruptions, quality issues, or unavailability caused by third-party providers including Twilio, Stripe, internet service providers, or telecommunications carriers. These third parties operate independently and are not agents or representatives of WorldDialer.

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WORLDDIALER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WORLDDIALER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.5 Liability Cap

WORLDDIALER’S TOTAL LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO WORLDDIALER FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANYTHING, WORLDDIALER’S LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10.6 Exceptions to Limitations

The limitations in this Section 10 shall not apply to:

  • Personal injury or death caused by WorldDialer’s gross negligence or willful misconduct
  • Fraud or intentional misrepresentation by WorldDialer
  • Liabilities that cannot be excluded under applicable law

Some jurisdictions do not permit the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.

11. Indemnification

11.1 Your Indemnification Obligation

You agree to indemnify, defend, and hold harmless WorldDialer, Polyiota LLC, and its officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your infringement of any third-party intellectual property rights
  • Content you transmit or cause to be transmitted through the Service
  • Calls you place that violate the Acceptable Use Policy or applicable telecommunications laws

This indemnification obligation survives termination of your account and these Terms indefinitely.

11.2 Defense of Claims

WorldDialer shall promptly notify you of any indemnified claim and shall cooperate with you in the defense of the claim. You shall have sole control of the defense and settlement, provided that you do not settle any claim in a manner that admits liability or imposes obligations on WorldDialer without our prior written consent.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

12.2 Mandatory Arbitration (US Users)

For Users located in the United States: You and WorldDialer agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and Procedures.

The arbitration shall be conducted in a location mutually agreed upon by the parties or as specified in the AAA rules. The arbitration shall be conducted by a single neutral arbitrator. Each party shall bear its own costs and attorney’s fees; however, the arbitrator may award reasonable costs and attorney’s fees to the extent permitted by applicable law.

12.3 Class Action Waiver

You and WorldDialer agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator shall have no authority to conduct class arbitration or consolidate claims.

If this class action waiver is deemed unenforceable, any class action, class arbitration, or representative proceeding must be brought in a court of competent jurisdiction (not in arbitration).

12.4 Exception for Small Claims

Notwithstanding the arbitration requirement, either party may bring an individual action in a court of competent jurisdiction, including small claims court, if the claim is within the jurisdiction of that court and does not involve injunctive or equitable relief.

12.5 Non-US Jurisdiction Dispute Resolution

For Users outside the United States: This mandatory arbitration requirement does not apply to you. Instead, disputes shall be resolved in the courts of your country of residence or as otherwise provided by the consumer protection laws of your jurisdiction. See Section 18 for jurisdiction-specific provisions.

12.6 Pre-Litigation Notice and Informal Resolution

Before initiating arbitration or legal proceedings, you agree to attempt to resolve the dispute informally by sending a detailed written notice to WorldDialer at support@worlddialer.com describing the nature of the dispute, the specific facts, and the remedy sought. You and WorldDialer shall attempt to resolve the dispute within thirty (30) days of receiving the notice. If the dispute cannot be resolved informally, you may pursue arbitration or litigation as outlined in this Section 12.

13. Termination

13.1 Termination by User

You may terminate your account and these Terms at any time by:

  • Logging into your account and following the account deletion instructions
  • Sending written notice to support@worlddialer.com

Upon termination, your account will be closed and you will no longer have access to the Service. Data retention and handling of remaining credits are addressed in Section 13.3 below.

13.2 Termination by WorldDialer

WorldDialer may suspend, restrict, or terminate your account and access to the Service at any time, in its sole discretion, for:

  • Violation of these Terms
  • Violation of the Acceptable Use Policy
  • Violation of any applicable law or regulation
  • Continued abusive behavior or misuse of the Service
  • Non-payment of amounts due
  • Failure to provide accurate or updated account information
  • Suspected fraudulent activity
  • Requests by law enforcement or governmental authorities
  • Any other reason that WorldDialer deems appropriate in its sole discretion

WorldDialer may provide notice of termination via email, but is not required to provide prior notice or an opportunity to cure violations. Termination shall be effective immediately upon notice.

13.3 Effect of Termination

Upon termination of your account for any reason:

  • All access to the Service is immediately revoked
  • Any subscription services are cancelled and no refunds are issued for the current or future billing periods
  • Unused calling credits are forfeited and will not be refunded
  • Call logs and account data may be retained in accordance with the Privacy Policy and applicable law
  • Your contact information will remain in our database to the extent required by law

Sections 1, 2, 6, 7, 8, 10, 11, 12, 13, 14, 15, 16, and 17 shall survive termination of these Terms.

13.4 Suspension of Service

WorldDialer may suspend the Service or specific features temporarily during maintenance, updates, or for security reasons without liability. WorldDialer will attempt to provide notice of planned maintenance, but is not obligated to do so. WorldDialer is not liable for any service interruptions.

14. Modifications to Terms

WorldDialer reserves the right to modify, amend, or supplement these Terms at any time. If we make material changes, we will notify you via email at the address associated with your account or by displaying a prominent notice on the Platform before the changes become effective. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms.

If you do not agree to any modifications, your sole remedy is to discontinue use of the Service. We will post the updated Terms with an updated “Effective Date” or “Last Updated” date on our website.

For customers in the EU/EEA: Material changes to these Terms may require explicit re-acceptance in compliance with consumer protection laws. We will request your affirmative consent to material changes.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, that provision shall be severed and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law. If necessary, the invalid provision shall be reformed to the minimum extent required to make it valid and enforceable while preserving the intent of the parties.

16. Entire Agreement

These Terms, together with the Privacy Policy, Acceptable Use Policy, and any other policies posted on the Platform, constitute the entire agreement between you and WorldDialer regarding your access to and use of the Service. These Terms supersede and replace any prior negotiations, understandings, or agreements, whether written or oral, regarding the Service.

No course of dealing, course of performance, or trade usage shall modify these Terms unless expressly agreed to in writing by an authorized representative of WorldDialer.

18. Jurisdiction-Specific Terms

18.1 EU/EEA Consumer Rights

For Users who are consumers residing in a Member State of the European Union, the European Economic Area, or the United Kingdom, the following additional terms apply and are in addition to the provisions elsewhere in these Terms:

18.1.1 Withdrawal Right

You have the right to withdraw from this Agreement within fourteen (14) calendar days from the date of purchase without providing any reason (the “Withdrawal Period”). This right does not apply to calls that have already been completed and delivered during this period.

To exercise your withdrawal right, you must send a clear written notice to support@worlddialer.com within the 14-day period. If you have already purchased credits and used them, any refund will be limited to the portion of credits you have not used.

18.1.2 Consumer Rights

Your consumer rights under EU/EEA consumer protection directives are not excluded or limited by these Terms. You retain all statutory rights as a consumer, including:

  • The right to receive Services that are fit for purpose
  • The right to remedies for defective Services, including repair or replacement
  • The right to refunds where Services are not supplied as described
  • The right to fair contract terms and protection against unfair contract terms

18.1.3 Dispute Resolution for EU/EEA Consumers

Notwithstanding the arbitration requirement in Section 12.2, if you are an EU/EEA consumer, you have the right to bring legal proceedings in the courts of your country of residence. You also have access to the Online Dispute Resolution (ODR) platform at https://ec.europa.eu/odr, which can facilitate out-of-court dispute resolution.

18.1.4 Right to Data Portability

In compliance with the General Data Protection Regulation (GDPR), you have the right to request a copy of your personal data that WorldDialer has collected. Submit such requests to support@worlddialer.com.

18.2 UK Consumer Rights

For Users residing in the United Kingdom who are consumers, the following terms apply:

18.2.1 Consumer Rights Act 2015

Your consumer rights under the Consumer Rights Act 2015 are not excluded or limited. You have statutory rights relating to the quality and fitness for purpose of digital services supplied to you. These statutory rights cannot be excluded or limited except to the extent that they are unreasonable.

18.2.2 Withdrawal Right

You have the right to withdraw from this Agreement within fourteen (14) calendar days from purchase for digital services not yet fully consumed.

18.3 Australian Consumer Law

For Users residing in Australia, nothing in these Terms excludes, restricts, or modifies any condition, warranty, right, or liability under the Australian Consumer Law, Part 2-2 of the Competition and Consumer Act 2010, or any other consumer protection legislation that cannot be excluded.

In particular, the Australian Consumer Law provides that services must be supplied with due care and skill, within a reasonable time, and at a reasonable price. If we breach these guarantees, you are entitled to a remedy such as repair, replacement, or refund.

18.4 California Consumer Rights

For Users who are residents of California, the following additional terms apply:

18.4.1 California Consumer Privacy Act (CCPA)

If you are a California resident, you have specific privacy rights under the California Consumer Privacy Act (CCPA), including the right to:

  • Know what personal information is collected
  • Know whether your personal information is sold or disclosed
  • Say no to the sale or sharing of your personal information
  • Access your personal information
  • Request deletion of your personal information (with certain exceptions)
  • Not be discriminated against for exercising your CCPA rights

To exercise these rights, please contact support@worlddialer.com. WorldDialer will respond to requests within forty-five (45) days.

18.4.2 Limitations of Liability in California

For California residents, the limitations of liability in Section 10 shall not limit liabilities for fraud, intentional misconduct, or liabilities that cannot be excluded under California law.

18.4.3 Arbitration Carve-Outs

For California residents: Notwithstanding Section 12.2, you may file suit in California courts for claims involving California employment law or for claims that would otherwise require a California court. California residents also retain the right to pursue claims in small claims court.

18.5 Canada

For Users residing in Canada:

  • These Terms are governed by the laws of Delaware, US, but subject to your rights under applicable Canadian consumer protection laws.
  • If any provision of these Terms would be unenforceable under Canadian law, that provision is void and unenforceable to that extent.
  • You retain all statutory rights as a consumer under Canadian federal and provincial consumer protection legislation.
  • The mandatory arbitration clause in Section 12.2 shall not apply to claims under the Canadian Consumer Protection Act.

18.6 Brazil

For Users residing in Brazil:

  • These Terms are subject to Brazilian consumer protection laws, including the Codigo de Defesa do Consumidor (CDC).
  • You have the right to cancel your subscription within seven (7) days of purchase without penalty.
  • In the event of disputes, you may pursue remedies under Brazilian law and in Brazilian courts.
